3. You agree that the website is offered with no warranty or promise, in any form and that we are not liable for software failure, data accuracy or any minimal level of functionality.
4. You agree to pay for all purchases you make thru our site. You understand that that all sales of Emission Offsets are final and you agree not to seek a refund for any purchases you make on the site. The company will reverse multiple purchases that occur within 10 minutes of the transaction, which appear to be caused by issues of browser use.
5. You understand that the company is not selling you actual offset commodities, but rather participation in the company's purchase and retirement of these offsets. Further you acknowledge that because the company retires exchange traded offsets, that the company has no liability regarding the compliance of the issuer of the contract.
6. You agree that you will not file privacy and spam complaints against the company, without contacting the company to resolve your complaint via its website or telephone. You also agree to compensate the company for any false complaints you may file, whether by error or intention and agree to pay the greater of $500 or actual damages in compensation.
7. You agree to that any legal disputes be resolved in Michigan district or circuit court for Washtenaw County, Michigan. You agree to pay the company's legal fees if you sue the company and lose.
